Terms of Service

These terms cover the HonestSky mobile app ("the App"), the website at honestsky.app ("the Website"), and the HonestSky newsletter ("the Newsletter"). Together, these are referred to as "the Service."

1. Acceptance of terms

By downloading, installing, or using the App, visiting the Website, or subscribing to the Newsletter, you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

HonestSky is a free weather application that displays forecasts, weather alerts, radar imagery, forecast maps, and air quality data sourced from third-party public APIs. The App is provided at no cost and is intended for personal, non-commercial use.

The Website provides information about HonestSky and allows visitors to subscribe to the Newsletter.

The Newsletter is a periodic email digest containing weather forecasts, week-ahead outlooks, and related content. If you provide your zipcode, the Newsletter may include a local weather forecast personalized to your area.

3. Weather data disclaimer

HonestSky is not a substitute for official severe weather warnings.

• Weather data is provided by third-party sources (Open-Meteo, National Weather Service, MeteoAlarm, Environment Canada, RainViewer) and may contain errors, delays, or omissions
• Forecasts are predictions and are inherently uncertain, especially for extended periods
• During severe weather events, always follow official guidance from your local emergency management agency, National Weather Service, or equivalent authority
• Do not rely solely on HonestSky for decisions that could affect personal safety, property, or critical operations

4. Newsletter

• By subscribing to the Newsletter, you consent to receive periodic emails from HonestSky
• You may unsubscribe at any time using the link in any Newsletter email
• If you provide a zipcode, it is used solely to personalize the weather forecast portion of the Newsletter. Your zipcode is not used for tracking, advertising, or any other purpose
• The Newsletter may include occasional sponsored content or mentions. Sponsors do not have access to your email address, zipcode, or any subscriber data
• We reserve the right to modify the frequency, content, or format of the Newsletter at any time

5. Limitation of liability

To the maximum extent permitted by applicable law:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
• We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components
• We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service
• We are not liable for the accuracy, completeness, or timeliness of weather data provided by third-party sources
• Our total liability to you for any claims arising from use of the Service shall not exceed $0 USD

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the App
• Use automated systems to scrape or extract data from the App, Website, or APIs beyond normal personal use
• Redistribute, resell, or sublicense any content from the Service
• Impersonate HonestSky or misrepresent your affiliation with the Service
• Subscribe to the Newsletter with fraudulent or disposable email addresses for the purpose of abuse

7. In-app purchases

HonestSky offers optional tip-jar donations through Apple App Store and Google Play Store. These are voluntary contributions and do not unlock additional features. All purchases are non-refundable as they are consumable donations. Refund requests should be directed to Apple or Google per their respective policies.

8. Intellectual property

The HonestSky name, logo (Shield Sky Mark), design, and original code are the property of their creator. Weather data is sourced from public APIs and is subject to their respective licenses and terms. Newsletter content is the property of HonestSky and may not be reproduced without permission.

9. Third-party services

The Service relies on third-party services for weather data, hosting, and payment processing. We are not responsible for the availability, accuracy, or policies of these services. Their terms and privacy policies apply to their respective services.

10. Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the state in which the developer resides.
